Why is the sale of laser pointers prohibited?
Even owning a high powered laser is problematic. This applies to weapons referred to in the weapons law. According to Section 1, paragraph 2, paragraph 2, weapons are not only portable items, but, by their very nature, aim to eliminate or reduce people’s attacks and defense activities. On the contrary, if such items apply here and are also mentioned in this law, they also fall into this scope. The extent of this applicability depends on the hazards caused by the corresponding laser radiation. For this reason, classification is carried out according to EN 60825-1.

Up to the 2M level, there is no problem in most cases, and the following levels are related to high hazards. Nonetheless, even in category 3B, whether they belong to the weapons law is questionable. The Federal Criminal Police Office is using the inspected green laser and similar laser pointers have not been used up because it is not listed as a weapon in the weapons law. However, if the laser pointer is mounted on a weapon or there is a device to connect it to the gun, the situation may be different. Accordingly, in some cases, laser pointers can also be regarded as prohibited weapons. Therefore, caution is recommended. It is best to ask the police before buying. Otherwise, the owner of the laser pointer may be sued under Article 52, paragraph 3, paragraph 1, WaffG.
