Some challenges from the red laser pointer
Most laser pointers on the market today have a maximum power of 5mW. The "Extreme Nexus" model that was sent to me was 95mW (they have some 300mW models by the way). Improper use of infrared laser pointers may cause temporary or even long-term vision damage to human eyes. Laser pointers programmed directly to 5mW power can cause temporary visual impairment. Let me tell you one thing, it's a hard-to-miss distinction. The high power laser pointer is green and clearly visible in the absence of smoke, mist or dust, especially in darker environments. Not only that, but it's actually still burning. Yes, you can feel that burning sensation on your skin. Yes, it's really a match, and it burns black plastic items that look like a terrifying lightsaber that stretches for miles into the sky.

How does the FDA define a laser pointer?
The FDA defines a laser pointer as a laser used at a point of view, beam, or laser for the primary purpose. The FDA limits these to less than 5 mW. Note that the size of the laser or battery operation is not a factor. Very few people will suffer eye injury from the beam emitted by a laser pointer below 5 mW. This power is inherently safe. However, it is prudent to never aim at someone's eyes or head. Having said that, extra effective lasers can eventually lead to permanent loss of vision as well as blindness. This difficulty is very serious, especially for underage children.
In practice, this means that if the Wicked Laser or anyone advertising the laser is used to point or observe the beam, it must be below 5 mW. But if the laser is advertised for burning or other non-visual display purposes, it can be of any power -- even if it's battery-powered and easy to hold. That's why HTPOW and others can keep selling these. If young people were given the device, they would randomly use a green laser pointer to participate with their buddies every day. In this form of problem, damage from your laser pointer can easily happen to very young children.
